The downtown bar district deserves a specific note. A pedestrian struck late at night in that area raises impaired-driving questions, which make liability hard to dispute and can support punitive damages under Civil Code section 3294. California's dram shop rules are narrow: Business and Professions Code section 25602 generally immunizes a licensee for serving an adult, with a specific exception under Civil Code section 1714 for serving an obviously intoxicated minor.

Rail crossings and the Fullerton transportation center

  • Crosswalk collisions at the campus-adjacent intersections, where Vehicle Code section 21950 requires drivers to yield.
  • Electric scooters, where helmet rules for riders under 18 and restrictions on where the device may operate affect the comparative fault analysis rather than the right to bring a claim.

One coverage point students consistently do not know: the uninsured and underinsured motorist coverage on your own auto policy, or on a parent's policy if you are a resident relative, generally applies when you are struck as a pedestrian or cyclist.
