Newport Beach Car Accident Lawyer

Our main office is at 4695 MacArthur Court, a few minutes from the Jamboree and Bristol interchanges, so the collisions described on this page happen on streets we drive every day. Newport Beach has an unusual traffic mix: heavy commuter volume into the Airport Area on weekday mornings, and a completely different beach and harbor pattern on summer weekends.

Where Newport Beach collisions happen

The city's crash patterns follow its two personalities. On weekdays the pressure is on the Airport Area and the arterials feeding it. On weekends it moves to the coast.

  • Pacific Coast Highway through Mariners Mile and Corona del Mar. A high-volume state highway running through retail frontage with constant left turns into and out of driveways, plus cyclists and pedestrians crossing to reach the water.
  • MacArthur Boulevard and Jamboree Road. Wide, fast, signalized arterials carrying commuters to the Airport Area and Fashion Island, where left-turn and red-light collisions cluster at the major intersections.
  • The SR-55 terminus at Newport Boulevard. The freeway ends and dumps traffic onto a surface street, and drivers routinely carry freeway speed into a street environment.
  • Bristol Street North and South, which function as one-way frontage roads alongside the SR-73 and confuse drivers unfamiliar with the pattern.
  • The Balboa Peninsula and Balboa Island, where narrow streets, angled parking, pedestrians and bicycles mix in summer, and where low-speed impacts still produce serious injuries to people on foot.
  • Back Bay Drive and the Newport Beach bike routes, which carry heavy cyclist traffic and see right-hook and dooring collisions.

The Mariners Mile stretch of PCH deserves a specific note. A driver turning left out of a shopping center across multiple lanes of highway traffic is the fact pattern behind a large share of the serious collisions on that road, and liability usually turns on Vehicle Code section 21804, which requires a driver entering a highway from a driveway to yield to traffic close enough to be a hazard.

Summer traffic and out-of-town drivers

From Memorial Day through Labor Day the peninsula and the beach-adjacent streets fill with drivers who do not know the area, are looking for parking rather than at the road, and are navigating by phone. Two practical consequences come up repeatedly in these claims.

First, the at-fault driver is frequently from out of state or out of county, which means an out-of-state insurer and sometimes a rental car policy. Rental coverage layers are their own puzzle: the rental company's liability coverage, the driver's personal policy, a credit card benefit, and any supplemental liability product they bought at the counter can all be in play, and the renter often has no idea what they purchased.

Second, witnesses scatter. A visitor who saw the collision is home in Arizona by Monday. Getting names and phone numbers at the scene matters more in a beach-city crash than almost anywhere else, because the police report will not catch everyone and nobody will be findable in a month.

What to do after a crash in Newport Beach

  1. Call 911 if anyone is hurt. Newport Beach Police respond to collisions on city streets; the CHP handles the SR-55, SR-73 and the stretch of PCH under state jurisdiction, so which agency takes the report depends on exactly where you stopped.
  2. Get examined the same day. Hoag Hospital is on Newport Boulevard near the PCH interchange and is the closest emergency department for most of the city. Serious trauma in Orange County is frequently routed to a designated trauma center elsewhere in the county.
  3. File the DMV SR-1 within 10 days if anyone was injured or property damage exceeded $1,000. This is required even when police took a report.
  4. Photograph the scene before vehicles move, including the driveway or intersection geometry and any sight obstruction, which matters enormously on PCH.
  5. Request the traffic collision report from the agency that wrote it. Reports typically take several days to become available.
  6. Note nearby cameras. Mariners Mile and Fashion Island area businesses commonly have exterior cameras, and that footage is usually overwritten within two to four weeks.

Where a Newport Beach case gets filed

Most Orange County civil injury lawsuits are filed at the Central Justice Center in Santa Ana, at 700 Civic Center Drive West, which handles general civil matters for the county. Complex civil cases are assigned to the Civil Complex Center, also in Santa Ana. The Harbor Justice Center on Jamboree Road in Newport Beach is the local courthouse, but general civil injury litigation for the county is centralized in Santa Ana rather than heard there.

Filing is a last step, not a first one. Most claims resolve with the insurer before a complaint is ever filed, and filing happens when the offer does not match the case or the two-year deadline is approaching.

Newport Beach questions

Do I have to use a Newport Beach lawyer for a Newport Beach crash?

No. Any California-licensed lawyer can handle it, and venue is based on where the crash happened and where the parties are, not on where the lawyer sits. That said, familiarity with the specific intersections, the responding agencies and the Orange County courts is genuinely useful, and our primary office is on MacArthur Court in Newport Beach.

The driver who hit me was a tourist with out-of-state insurance. Does that complicate things?

It adds steps rather than obstacles. An out-of-state insurer still has to respond to a claim arising from a California crash, and California law governs the claim. Rental vehicles add layers of potential coverage worth identifying early, including the rental company's policy, the driver's own policy and any supplemental product purchased at the counter.

I was hit riding my bike on PCH. Is that treated differently?

A cyclist has the same right to the roadway as a driver, and the claim proceeds on the same negligence principles. Two practical differences: the injuries tend to be more severe, and the uninsured motorist coverage on your own auto policy generally applies to you as a cyclist, which matters when the driver has minimum limits or fled.

Where do I get the police report?

From the agency that responded. Newport Beach Police handles most city street collisions and the CHP handles the freeways and state highway segments. Reports generally take several days to be released, and we can obtain it for you as part of the case rather than leaving you to chase it.
