Vehicle Code section 21801 requires the turning driver to yield to oncoming traffic close enough to be a hazard, and because these impacts are near-perpendicular into the passenger compartment, the injuries are disproportionate to how routine the crash looks on a report.
Canyon and coastal collisions
Laguna Canyon Road and the coastal routes are a different problem entirely. Two-lane roads, blind curves, limited shoulders, variable surface conditions and a steady volume of motorcycles and bicycles.
Evidence is the central difficulty. There are often no independent witnesses, cell coverage can be unreliable, and the mechanism is typically either a vehicle crossing the center line on a curve or a surface hazard rather than a conventional intersection conflict. What usually resolves these cases is physical: scene measurements, gouge marks and the point of rest, the vehicles' event data, and increasingly helmet or bike camera footage.
- Lane splitting is lawful under Vehicle Code section 21658.1. An insurer cannot establish a rider's fault simply by noting that they were splitting lanes; they have to show the manner was unreasonable.
- California's universal helmet law is Vehicle Code section 27803. If a rider was not wearing one, recovery can be reduced to the extent that contributed to the specific injuries, which applies to a head injury and not to a broken leg. It does not eliminate the claim.
- Where the cause was gravel, a pavement seam, a pothole, debris or standing water, a dangerous condition of public property claim under Government Code section 835 may exist. The administrative claim deadline is generally six months under Government Code 911.2, and hazards are often repaired within days, which destroys the proof.
- Cyclists on the coastal routes face right-hook and dooring collisions, governed by Vehicle Code sections 21717 and 22517, and unsafe passing under the Three Feet for Safety Act, section 21760.
- Uninsured and underinsured motorist coverage on your own auto policy generally applies when you are struck while riding a bicycle or walking, which matters because California's minimum liability coverage is $30,000 per person.
